Distance Sell Contract

ARTICLE 1 – SUBJECT

The subject of this contract to determine the rights and obligations of the parties in accordance with the provisions of the Regulation on Procedure and Principle of the Distance Sale Contracts regarding the Consumer Protection Law (numbered 4077), in terms of the sale of vacation house rental services and deliverance of agreed property for the agreed time period by the SELLER (herein this contract to be referred to as ‘DOLCEVITA’) to the BUYER (herein this contract to be referred to as ‘GUEST’).

ARTICLE 2 – GUEST

The GUEST is the person who committed and made payment towards the purchase of services offered in website name www.kasholidayvillas.com

ARTICLE 3 – SELLER- DOLCE VITA

The official title of the company is Prenses Turizm Sanayi ve Tic. Ltd. Şti.

ARTICLE 4 – INFORMATION ABOUT THE SERVICE SUBJECT TO THE CONTRACT

It comprises the information regarding the service of allocation and delivery of the vacation house reserved and paid for it by the ‘GUEST’ through www.kasholidayvillas.com to the GUEST for the agreed duration.

ARTICLE 5 – GENERAL PROVISIONS

5.1 – Reservation

Once the GUEST decided vacation dates and the house he wants to stay in, will contact DOLCEVITA who will do all necessary check of availability and send the Pre Approval Form.

5.2 – Payment Terms

GUEST is obliged to pay the deposit amount of %40 of the total sum to DOLCEVITA’s bank account within 2 business days. GUEST hereby agrees that if the deposit is not received within 2 business days reservation will be cancelled. Remaining balance will be paid by the GUEST to the account of

DOLCEVITA 15 days prior to the scheduled stay in the vacation house

5.3 – Price

All prices are listed in details for the services sold in the website www.kasholidayvillas.com. DOLCEVITA reserves the right to give different price for daily, weekly or monthly reservations. GUEST understands that the properties rented for vacation may be belong to third parties and DOLCEVITA bears no responsibility to issue invoice for the monies paid to and for the third party. Therefore GUEST can only ask for invoice for the agency service fees paid to DOLCEVITA for their stay.

5.4 – Security Deposit and Check In

GUEST understands and agrees to pay 500-1500 TRY as security deposit for possible damages at the time of Check In. In the case that this security deposit is not paid, DOLCEVITA has the right to not let the GUEST in. DOLCEVITA accepts and undertakes to return this deposit in full after fully checking the property at the time of the check out provided that there is no damage occurred.

5.5 – Check In – Check Out Times

GUEST accepts and undertakes that check-in time to the vacation house will be after 16:00 pm and check-out time is 10:00 am. Geographical location of the vacation rental is clearly shown in www.kasholidayvillas. com website therefore no claims regarding location will be considered

5.6 – Capacity and Furniture

GUEST agrees and undertakes not to bring additional guests to the vacation rental other that the count agreed and definitely not more than the capacity of the vacation rental as specified in the website. Kids older than 2 years are counted.

5.7 – Smoking And Pets

GUEST agrees and undertakes not to bring any pet to the vacation rental and not to smoke in any of the enclosed areas.

5.8 – Other Services

All other services rendered will be priced and paid separately upon agreement between DOLCEVITA and GUEST. No other services other than renting of the vacation house is not included herein this contract.

5.9 – Change of Dates and Reservations

GUESTS may request change of dates up until 30 days before the day of stay and it will be considered if there is availability. There will be 100 TL change of reservation fee applied.

5.10 – Effectiveness

This contract shall come in to force upon GUEST’ reservation inquiry made through www.kasholidayvillas. com is approved by DOLCEVITA via email and honored thereto by the GUEST.

ARTICLE 6- RIGHT OF WITHDRAWAL

GUEST have to right to withdraw from the vacation rental agreement within (7) days after the date this contract became effective. In order to use the withdrawal right, the GUEST must notify DOLCEVITA within this period via fax, e-mail or phone.

ARTICLE 7- CASES WHEN RIGHT OF WITHDRAWAL CAN NOT BE USED

If the reservation is canceled up until 31 days prior to the agreed check in date, %40 of the down payment (deposit) will be kept. No deposit amount will be refunded if the reservation is cancelled 30 days or less prior to the agreed check in date. If the reservation is cancelled between 15-30 days prior to agreed check in date, GUEST agree and undertake to pay %50 of the total sum of stay to DOLCEVITA. If the reservation is cancelled 14 days OR LESS prior to agreed check in date, GUEST agree and undertake to pay %50 of the total sum of stay to DOLCEVITA.

ARTICLE 8- AUTHORIZED COURTS

Up to the value announced by the Ministry of Industry and Trade, the Consumer Arbitration Boards and the Consumer Courts of DOLCEVITA’s region shall be authorised to implement this agreement. The GUEST shall be considered as having accepted all conditions hereof upon the completion and approval of reservation.
